Information on the processing and protection of personal data
The Infoservice S.R.L., current in Rome via Casilina no. 3 / T, in person of the legal pro tempore representative, in the capacity of Data Controller, pursuant to and for the purposes of the privacy and security law, as outlined in the Code on the Protection of Personal Data , D.lgs. 196/2003 and ss. In accordance with the relevant Community legislation, hereby informs the following information pursuant to art. 13 of the said decree:
Foreword The privacy and personal data protection of users is one of the primary goals of the www.linkavel.com Web Portal (hereafter linkavel.com), the exclusive property of Infoservice srl. Most of the Portal can be visited without any personal information being required. In fact, this type of data must be provided solely and exclusively for the benefit of particular services offered to users. The information is made only for the web linkavel.com Portal and not for other websites that the user may possibly consult via links.
1. Type of data
Through the Portal linkavel.com only the navigation data are collected, which concern both Passengers-Users and Carriers and in any case all those who connect to it. In addition, for the purposes set out below, the following are collected: 1) Carrier common data such as, for example, social, physical and electronic address etc; 2) the Passenger-Passenger’s e-mail addresses subject to their specific request. These addresses, once they have completed the required service, will be deleted immediately.
2. Purpose of collection
Collection of such personal information is limited to the information strictly necessary for the specific request of the users, to access the services provided on the Portal, to receive information etc.
3. Treatment Mode
The treatment is informed on the principle of necessity as identified in art. 3 D.lgs. 196/2003. Data is obtained through the compilation of any form of collection and / or through spontaneous statements made by the interested party in order to benefit from the services rendered on the Portal, to receive information as well as to the connections in the case of navigation data. Data is processed with the help of electronic instruments. The methods of collection and treatment are those outlined in art. 11, I paragraph D.lgs. 196/2003 below: “Personal data subject to processing are: a) treated legally and according to fairness; B) collected and recorded for specified, explicit and legitimate purposes, and used in other processing operations in terms compatible with those purposes; C) accurate and, if necessary, updated; (D) relevant, complete and not excessive in relation to the purposes for which they are collected or subsequently processed; (E) kept in a form allowing the identification of the person concerned for a period of time not exceeding that required for the purposes for which they were collected or subsequently processed. The Web Portal linkavel.com delivers its cloud services through a Microsoft-owned infrastructure, and data is allocated on distributed servers even outside the national borders. Microsoft will handle all organizational and technical measures, internal controls, and data security procedures that are designed to protect them from accidental loss or alteration, disclosure, or unauthorized access, as well as unlawful destruction. Microsoft, its affiliates and its subcontractors process the Data by processing the same on behalf of Infoservice srl for the entire term of validity of the Agreement between the same contract. Navigation data is not treated in any way for profiling the user’s tastes. In addition, user data will in no way be used to submit commercial and / or advertising proposals.
4. Obligation to confer
Consequences of Refusal. The provision of certain data is compulsory because it is not possible to perform the provision of the requested service. The compulsory data will be marked with an asterisk. Further optional data may be required; Their non-delivery does not in any way affect the evasion of the service request.
6. Carrier Data Conservation
Infoservice srl will retain the data of Carriers for the period provided by Italian law in force regarding the protection of personal data, even after expiration and / or termination of the contract. In the latter case, the person concerned is required to extract the personal data concerning him. After the compulsory retention period by law referred to in the previous paragraph, Infoservice srl will provide for their cancellation. Users – passengers. – Passenger-Passenger data, possibly processed on specific request, will not be retained beyond the time required to complete the required service.
In order to comply with the above-mentioned obligations and purposes, personal data may be disclosed to the following structures and / or external parties on the basis of their respective competencies: – Microsoft Corporation, its affiliates and subcontractors, Legal advice, Commercial and labor; Credit institutes; Poste; Customers and / or suppliers; Transport company; Company for the assignment and recovery of credits and in any case all those parties to whom the communication is necessary for the proper fulfillment of the stated purposes. They may also be communicated to the Judicial and / or Administrative Authorities in the fulfillment of legal obligations and / or the Privacy Authority in compliance with the obligation under Art. 157 Dlgs 2003/196. In the above mentioned communication, the data may be transferred, stored and processed in the United States or any other country where Microsoft, its affiliates or subcontractors are present in order to provide the Services. Microsoft Corporation and its subsidiaries in the United States adhere to Safe Harbor protocols of the European Union (EU Safe Harbor) and Safe Harbor of Switzerland (Swiss Safe Harbor). Microsoft Corporation, where it has to transfer personal data to subcontractors, will agree in advance with the same written contracts in which the subcontractors undertake to provide at least the same level of data protection required by the relevant Safe Harbor principles. The transfer is always carried out within the scope of the above-mentioned purposes, that is, the management and the conduct of the relationship in progress. Therefore, it is subtracted from the discipline of the consensus, respectively pursuant to art. 42 and 43 of the Dlgs. 196/2003.
The data provided by the Carriers will be disseminated by the Holding Company in accordance with their specific request on the web portal www.linkavel.com, which is the exclusive property of Infoservice srl and on the linked web sites as per specific agreement between Carriers and Company Infoservice srl Holder of the treatment. Passenger-passenger data will not be disseminated.
9. Duration of treatment
Carrier data is processed for the entire duration of the contractual relationship and for the pre-arranged period for the establishment of the same; As well as, even after the termination of the report, for as long as is necessary for the pursuit of the stated purposes and in any case for the period provided for by the applicable law. Passenger-Passenger data are processed on specific request of the same for the services rendered on the Portal. Once the requested service has been made, such data is immediately deleted.
In accordance with Legislative Decree 196/2003, art. 24 lett. A, b, d, f, the processing of common data for the pursuit of the above stated purposes does not require any consent.
11. Rights of the party concerned
Art. 7 Dlgs. 196/2003 “Rights of access to personal data and other rights” 1. The data subject shall have the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form . 2. The person concerned has the right to obtain the indication: a) of the origin of the personal data; B) the purposes and methods of the treatment; C) the logic applied in the case of processing carried out with the aid of electronic instruments; D) the identification details of the holder, the persons responsible and the representative designated pursuant to art. 5 paragraph 2; (E) the subjects or categories of persons to whom the personal data may be disclosed or who may become aware of it as appointed representative in the territory of the State, of persons in charge or in charge. 3. The person concerned has the right to obtain: a) updating, rectification or, where relevant, the integration of the data; B) cancellation, transformation into anonymous form or blocking of data processed in violation of law, including those that are not required to be kept in relation to the purposes for which the data was collected or subsequently processed; (C) the attestation that the transactions referred to in points (a) and (b) have been made aware, including their content, of those to whom the data have been communicated or disseminated, except where such fulfillment is Reveals it impossible or involves the use of means manifestly disproportionate to the protected right. 4. 12. Holder of the treatment and in charge
The Holder of the treatment is the Infoservice S.R.L., for the above identified. 13. Updating the information
This information may be updated as long as there is a need for adaptation to legislative and / or regulatory changes to the provisions governing the protection of personal data. In this case, the updated version will be published on the Portal.
